These terms are a contract between you and Tender. Read them — they describe exactly what happens to your money at each step, and what we can and cannot do with it.
Tender is operated by useTender LLC, a Wyoming limited liability company in formation ("Tender", "we", "us"). You can reach us at support@usetender.io. By depositing into the vault or placing an order, you agree to these terms.
You deposit USDG, a US-dollar-pegged stablecoin, into TenderVault, a smart contract on Robinhood Chain. The balance stays yours:
Tender is not a bank, a custodian, an exchange or a money transmitter. We do not hold deposits for you, pay interest, or transmit money to third parties on your behalf. Your deposit is not insured by the FDIC or any other body.
You must be at least 18, ship to a US address, and use Tender for your own personal, non-commercial orders. You may not use Tender if you are subject to US sanctions, are located in a sanctioned jurisdiction, or are barred from using our merchants' or payment partners' services. We may ask for information to verify any of this, and may refuse service.
Tender is new and runs with deliberate limits: a maximum item price, a maximum per order, per-day and per-week limits per customer, a limit on how much the whole service will spend in a day, and a short holding period on new deposits before they can be spent. The current values are shown when you order. We may change them at any time, including mid-session, and we may put an order into manual review before it is bought.
No flights or travel, no digital goods or software, no gift cards or stored value, no gambling, and no age-restricted, regulated, hazardous, perishable, counterfeit or illegal items. We can refuse or cancel any order for any lawful reason — including a price that looks wrong, a merchant that refuses us, or a risk signal we do not like. If we refuse before buying, you are not charged.
Everything is priced and settled in USDG. The fee is shown in the quote before you sign, and the total you sign is a ceiling, not an estimate. Merchant prices, taxes and shipping change constantly; if a quote expires, request a new one. We are not responsible for a merchant's own pricing errors, and a price shown in a quote is not an offer by the merchant.
Orders ship from the merchant to the address you give us. Delivery times are the merchant's and carrier's, not ours; we pass tracking through as we receive it. Give us an accurate address — we cannot redirect a parcel once the merchant has shipped it, and we are not responsible for a parcel delivered to an address you typed wrong. Risk of loss passes to you on delivery.
Keep your wallet secure. Anyone who can sign with your wallet can approve an order from your balance, and on-chain transactions cannot be reversed by us. If you lose your keys, we cannot recover your funds. Give accurate shipping details, don't use Tender to resell, and don't try to break, probe or overload the service.
Tender is a new service in an early release. The vault contract has been through internal security review and red-teaming; an independent external audit is in progress and has not yet been completed. Smart contracts can contain bugs, chains can reorganise or halt, stablecoins can depeg, and merchants and payment partners can fail. Only deposit what you are comfortable putting at risk, and withdraw your free balance whenever you are not using it. Service can be paused or discontinued at any time; withdrawals of free balance remain available when it is.
We can suspend or close an account for fraud, abuse, sanctions or legal risk, or for repeated returns or chargeback-like behaviour. Suspension does not touch your ability to withdraw your free balance from the vault — that is enforced by the contract, not by us.
Tender is provided "as is". We make no warranty about merchandise — the manufacturer's and merchant's warranties are the only ones that apply, and we pass through what we can. To the fullest extent the law allows, our total liability for any order is limited to the amount that settled for that order, and we are not liable for indirect, incidental or consequential damages, for lost profits, or for losses caused by your own wallet, a chain, a stablecoin issuer, a merchant or a carrier. Some states don't allow these limits, in which case they apply as far as they can.
We may update these terms; the effective date above changes when we do, and continuing to use Tender means you accept the update. These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes go to the state or federal courts sitting in Wyoming, and you and we each waive a jury trial. Nothing here removes a right you have that cannot be waived under the law where you live.

What we collect, why we have it, and who else sees it.
To price and place your orders, to ship to you, to check for fraud, abuse and sanctions risk, to answer support, to keep the service running, and to meet our legal and tax obligations. We do not use your data for advertising, and we do not sell it.
Deposits, holds, settlements and refunds are recorded on a public blockchain by design. Anyone can read them, we cannot delete them, and they are linked to your wallet address forever. That is the trade-off that makes the vault non-custodial.
Order and shipping records for as long as needed for returns, accounting and legal requirements, typically seven years. Server and risk logs for a short retention window. Contact details until you ask us to remove them.
Data sits in a firewalled, access-restricted database; operational keys are encrypted and held only by the service that needs them; gift-card codes are stored encrypted and are not shown to customers. No system is perfectly secure, and we will tell affected customers promptly if that ever fails.
Email support@usetender.io to see what we hold about you, to correct it, or to ask us to delete what we are not legally required to keep. We do not use advertising or analytics trackers; the site stores only what it needs to keep you signed in.
Tender is not for anyone under 18, and we do not knowingly collect data from them.
